Terms of Contract
Contract between the Traditional Irish Music Education Society (hereafter referred to as TIMES), and the named individual entered above (hereafter referred to as INSTRUCTOR) regarding the O’Flaherty Irish Music Retreat (hereafter referred to as RETREAT):
1. INSTRUCTOR agrees to be engaged as an independent contractor and will prepare and conduct instructional classes, lectures/workshops, and/or performances at the RETREAT during the period October 22 – 25, 2026. Specifically, the INSTRUCTOR’S responsibilities include:
  
  a. Teach three one-hour Instructional Classes per day during the RETREAT;
  
  b. Teach a one-hour Lecture OR Workshop the topic and content of which are determined by INSTRUCTOR and approved by RETREAT Director OR present a one-hour Informance;
  
  c. Co-lead with a group of INSTRUCTORS a 90-minute session with students one evening after INSTRUCTOR concerts;
  
  d. Perform during an INSTRUCTORS’ concert during one evening of the RETREAT. Concert may be performed solo or with others according to INSTRUCTOR’S wishes; and,
  
  e. Perform during our closing concert featuring all of our INSTRUCTORS on Sunday evening.
1. TIMES agrees to pay an Honorarium fee of $1,800.00 (USD) to the INSTRUCTOR for INSTRUCTOR’S services listed in this Contract. See item 6 for additional fees and item 8 for payment options.
1. TIMES will provide lodging, local transportation, and meals for INSTRUCTOR on the days that INSTRUCTOR provides the services herein described as a paid contractor at the RETREAT.
2. Unless already obtained by INSTRUCTOR for other purposes or not required for this engagement, INSTRUCTOR will be included in a group P-3 visa application obtained and paid for by TIMES for the sole purpose of the RETREAT covering Wednesay, October 21, 2026 to Monday, October 26, 2026.
3. At TIMES expense, TIMES will arrange INSTRUCTOR’S travel from a major airport near INSTRUCTOR’S residence, and a return flight. Travel from/to other locations can be made if the cost is no greater than the return flight to/from near the INSTRUCTOR’S residence. INSTRUCTOR must arrive at DFW airport no later than Thursday, October 22, 2026 by 5 p.m. and depart after 10 a.m. on Monday, October 26, 2026; however, it is recommended that INSTRUCTOR arrive on Wednesday, October 21, 2026 to adjust to the Texas time zone and reduce jet lag. TIMES will provide lodging and meals for those who arrive directly from Ireland that Wednesday. Should the INSTRUCTOR wish to arrange additional travel outside of the INSTRUCTOR’s responsibilities as detailed in this Contract, TIMES will contribute the amount of the initial roundtrip airfare to/from near the INSTRUCTOR’S residence.
4. In addition to INSTRUCTOR’S Honorarium fees, TIMES will provide INSTRUCTOR a stipend of $500.00 (USD) if INSTRUCTOR is added to TIMES’ group P-3 visa application, to cover any costs associated with INSTRUCTOR’S completing consulate interviews, checked baggage fees, and travel-related expenses other than flights and transportation to and from the RETREAT and DFW airport. For INSTRUCTORS who have their own visas, TIMES will provide a $200.00 (USD) stipend to cover other travel-related expenses.
5. TIMES will operate a RETREAT STORE at which INSTRUCTOR’S books, recordings, and other music-related merchandise will be sold provided INSTRUCTOR has directly participated as a principal performer/author. Unsold merchandise and a corresponding sales log will be returned to INSTRUCTOR at the RETREAT’s designated hotel on Sunday evening after the store closes. INSTRUCTORS will receive 97% of the (USD) proceeds from the sales. TIMES will retain 3% of the (USD) proceeds from the sales to cover credit card processing fees. INSTRUCTORS whose products are sold will be responsible for all pertinent taxes, if any.
6. Payment to INSTRUCTOR for honorarium, stipend and merchandise will be made with Check, PayPal, or Wire Transfer as directed by INSTRUCTOR. All fees will be paid by the end of the RETREAT calculated on the exchange rate on the day payment is made with the exception of Wire Transfers. Please allow up to one week for Wire Transfers to complete for any or all payments.
7. INSTRUCTOR gives permission to TIMES and its representatives to photograph, videotape and record INSTRUCTOR’S classes, performances and interviews for its use in the marketing of RETREAT or for its educational purposes. Unless INSTRUCTOR objects in writing, such recordings of performances may also be used for fundraising through CD or video sales and INSTRUCTOR’S concert(s) may be streamed live through a secure Internet concert site to help raise needed funds to defray the cost of the RETREAT.
8. INSTRUCTOR agrees to defend, indemnify and hold harmless TIMES, its volunteers and managers, its board of directors, and other representatives, from and against any and all actions, costs, claims, losses, expenses or injuries arising out of the acts of INSTRUCTOR at RETREAT, including liability for taxes, insurance and workers’ compensation.
9. In the event that illness, injury, travel restrictions, acts of God, or Force Majeure prevent INSTRUCTOR from attending, this Contract becomes null and void.
